Terms and Conditions of Sale

The Estonian National Museum, registry code 70005536, address Muuseumi tee 2, 60532 Tartu (hereinafter the Service Provider), and the customer who places an order in the museum’s online shop and identifies themself by entering their personal data in the order (hereinafter the Service User), have entered into this online shop user agreement (hereinafter the User Agreement).

1. Online Shop

1.1 The Estonian National Museum online shop (hereinafter the Online Shop) is an online store created by the Service Provider through which products are sold to the Service User.

2. General Provisions

2.1 In regulating their mutual relations, the parties shall be governed by the Law of Obligations Act, other laws and legislation of the Republic of Estonia, and the provisions agreed in the Online Shop User Agreement.

2.2 The Service Provider has the right to make changes to the Online Shop service at any time.

2.3 The Service Provider has the right to amend the terms of the User Agreement unilaterally, without any obligation to notify the Service User thereof in writing by email.

3. Products and Placing Orders

3.1 Products displayed in the Online Shop are generally in stock. The availability of products displayed in the Online Shop may change due to technical issues in the warehouse or Online Shop software.

3.2 If a product is out of stock and the order cannot be fulfilled, an employee of the Online Shop shall contact the user and offer either a possible new delivery time, replacement of the product with another equivalent product of the same price and quality, or a refund of the amount paid. The amount paid shall be refunded to the Service User without delay, but no later than within 30 days after the order was placed.

3.3 Product images displayed are illustrative in nature and may differ from the actual product. Product descriptions may not be exhaustive and may contain unintended errors.

3.4 Products offered in the Online Shop are sold to both natural persons and legal persons.

3.5 The Service User confirms that they are at least 15 years of age.

3.6 The Service User selects the desired products and undertakes to enter the information required to fulfil the order (surname, first name, contact telephone number, email address, delivery address, postal code) and to pay for the products either via internet banking bank link or on the basis of a prepayment invoice.

3.7 The Service User undertakes to provide truthful information necessary for fulfilment of the order when placing the order. The Service Provider shall not be liable for failure to fulfil an order, or for any consequences arising therefrom, where this is caused by incorrect information submitted by the Service User.

3.8 The sale is deemed concluded once the Service User has submitted the order through the Online Shop website and has paid for the order.

4. Prices

4.1 All prices in the Online Shop are stated in euros and no value added tax shall be added to them.

4.2 The Service Provider has the right to change the prices displayed in the Online Shop at any time. If the prices in the Online Shop are changed after the Service User has placed and paid for the order, the Service Provider undertakes to deliver the relevant products to the user at the prices valid at the time the order was placed. The Service User shall not have the right to demand compensation for any price difference.

5. Delivery Time and Delivery Conditions

5.1 The Service User has the right to choose between different methods of receiving the goods, and the transport cost depends on the weight of the products.

5.1.1 For dispatch of the goods, the Service Provider offers the following options:

  1. standard letter
  2. Omniva parcel machine
  3. international delivery
  4. delivery to a post office
  5. courier

5.1.2 The Service User may also choose to collect the goods in person in Tartu at Muuseumi tee 2.

5.2 If the Service User has chosen one of the delivery methods set out in clause 5.1.1, the goods shall be delivered within 7 working days.

5.3 If the Service User has chosen to collect the goods in person, the Service User shall be informed by telephone or email when the goods ordered are ready for handover. Such information shall be communicated to the Service User no later than within 5 working days from receipt of payment in the Service Provider’s settlement account.

5.4 The ordered goods shall be handed over only to the Service User indicated in the order upon presentation of an identity document. Goods shall be handed over to third parties only by agreement with the Service User.

6. Withdrawal from the Contract

6.1 If the Service User wishes to withdraw from the contract after placing the order and before performance by the Service Provider, the Service User undertakes to notify the Service Provider thereof in writing as soon as possible. Written notice must be sent by email to myyk@erm.ee. The email must indicate the order number from which withdrawal is sought and include the Service User’s contact details (first name, surname, date of placing the order, contact telephone number).

6.2 If the notice of withdrawal reaches the Service Provider after the contract has already been performed by the Service Provider, withdrawal from the contract shall take place in accordance with the chapter “Right of Return” of the Online Shop User Agreement.

6.3 The Service Provider shall refund the amount paid to the Service User without delay, but no later than within 30 days from receipt of the notice of withdrawal from the contract.

6.4 The refund shall be transferred to the same bank account from which the payment to the Service Provider was made.

7. Right of Return

7.1 Goods purchased from the Online Shop are subject to a 14-day right of return.

7.2 The returned product must be free of defects, complete, in its original packaging, and unused.

7.3 The right of return does not apply to audio and video recordings in opened packaging.

7.4 In order to return a product, a notice of withdrawal must be submitted by email to myyk@erm.ee.

7.5 Upon withdrawal from the contract, the consumer must return the purchased item without delay, but no later than within 30 days after notifying withdrawal from the contract.

7.6 In the event of return, the amount shall be refunded to the Service User without delay, but no later than within 30 days after receipt of the notice of withdrawal from the contract.

7.7 The refund shall be transferred to the same bank account from which the payment to the Service Provider was made.

7.8 The Service User undertakes to bear the cost of returning the goods up to the amount of 10 euros, unless the product to be returned did not correspond to the consumer’s order. If the return is not due to a product damaged or defective through the fault of the Service Provider, the return costs shall be borne by the Service User.

7.9 The 14-day right of return does not apply to the following goods: products made taking into account the personal needs of the Service User, and audio and video recordings where the Service User has opened the packaging.

7.10 If, after return of the product, it appears that the product does not meet the conditions set out in clauses 7.1–7.4 of the Online Shop User Agreement, the amount shall not be refunded to the Service User, and the returned product shall remain in storage with the Service Provider. The costs associated with storage or return of the product to the Service User shall be borne by the Service User.

8. Procedure for Filing Complaints

8.1 Products sold through the Online Shop are subject to the two-year period for filing complaints provided for in subsection 218(2) of the Law of Obligations Act.

8.2 Complaints shall be handled in accordance with the procedure for handling complaints.

9. Personal Data and Their Use

9.1 The Service User gives the Service Provider clear and informed consent to process their personal data.

9.2 The personal data of the Service User entered by the user when placing the order and made known to the Service Provider shall be entered in the customer register and used for providing the sales service and offering goods to the Service User.

9.3 The source of the personal data is the establishment of the customer relationship upon registration of the order in the Online Shop.

9.4 The personal data recorded include the following information concerning the Service User’s order: first name(s), surname, telephone number, email, street, house/apartment, city/settlement, postal code, acceptance of the Online Shop purchase conditions, and consent to receiving sales offers at the email address.

9.5 Personal data are processed by the Estonian National Museum, registry code 70005536, address Muuseumi tee 2, 60532 Tartu.

9.6 The personal data of the Service User that are necessary for delivery of the goods to the Service User shall be forwarded to the courier service provider.

9.7 Protection of personal data is ensured by all security measures required by law.

9.8 The Service Provider undertakes not to transmit registered personal data to unauthorised persons.

9.9 The Service Provider reserves the right to transmit personal data concerning the Service User to persons who have a legal right to receive such data and who process the data for the performance of a duty prescribed by law, and also to persons who have a legal right to receive such data where this is necessary for the protection of the life, health or freedom of the Service User or another person.

9.10 The Service User has the right to review personal data concerning them, and also to amend such data or request removal of their personal data from the register.

9.11 The Service User gives the Service Provider consent to send an order confirmation to the email address entered when placing the order.

10. Liability

10.1 The Service Provider’s liability is limited to the sale price of the product. The Service Provider shall not be liable for defects caused to the products by the buyer.

10.2 The Service User undertakes to use the Online Shop service only in accordance with the law and good practice.

10.3 The Service User shall bear full responsibility for all expenses related to the acquisition and maintenance of the software and data communication systems required for use, as well as for any other expenses arising from use of the Online Shop service.

10.4 The Service User shall be fully liable for any damage caused to the Service Provider, other Service Users, or third parties through use of the Online Shop contrary to the terms of the Online Shop User Agreement or contrary to law or good practice.

11. Disputes

11.1 Any disputes arising from the Online Shop User Agreement between the Service User and the Service Provider shall be resolved in accordance with the legislation in force in the Republic of Estonia. If no agreement is reached, the dispute shall be resolved by the Tartu County Court.

12. Terms of Use

12.1 The Service User is required to familiarise themself with the terms set out in the User Agreement.

12.2 By placing an order and ticking the box “I agree to the purchase terms”, the Service User confirms that they have familiarised themself with the terms set out in the User Agreement, understood them, and agree to the terms of the User Agreement.

13. Privacy of Card Payments in the Online Shop

13.1 Internet card payments (Visa, MasterCard)

After the order has been placed, the customer is directed to the secure environment of Nets Estonia AS to make the payment. There, a pre-completed payment order is displayed stating the amount due. After entering the card number, security code (the three-digit code on the back of the card), and the card expiry date, Nets Estonia authorises the transaction with the customer’s bank.

When card data are requested, the SSL security protocol is used together with the MasterCard SecureCode and Verified by Visa security programmes, which ensure that the information exchanged cannot be intercepted or altered by unauthorised persons.

14. Methods of Payment

14.1 In the Online Shop, products may be paid for by bank link or credit card.
